All prices on the www.golfmegastore.it website include VAT. They are subject to change without notice. The terms and conditions described here govern the sales contract between the “Buyer” and the online store www.golfmegastore.it, hereinafter referred to as the “Seller.”

1. COMPLETION OF THE CONTRACT
The Buyer’s purchase order constitutes a binding contractual proposal. The Seller accepts the purchase order with an order confirmation sent via email, which contains a description of the characteristics of the ordered product and the essential elements of the contract (price, payment method). If the Buyer does not receive an order confirmation from the Seller or any other communication from the Seller within 48 hours of placing the order, the Buyer is required to contact the Seller promptly at info@golfmegastore.it.

2. PURCHASE OF PRODUCTS
The Products on the site may be purchased by the Buyer by adding them to the appropriate shopping cart. Once the Buyer has completed the Product selection and wishes to proceed with the purchase of those placed in the cart, he or she will be asked to provide the required information on the Site in order to complete the Contract. Specifically, the Buyer will be asked to provide, in a dedicated section of the Site, his or her personal details, email address, address, and the delivery address for the Products (if different from the original), his or her billing address, and a telephone number where he or she can be contacted for information on the delivery date of the Products. If the Buyer chooses to pay by credit card, he or she must provide his or her credit card details via a secure PayPal connection, which Golf 2.0 Megastore staff will never have access to. For accounting and administrative purposes, the Seller reserves the right to verify the personal information provided by the Buyer. In the case of payment by credit card, the purchase amount will be charged to the Buyer after the order has been completed on the site.

3. DELIVERY OF MERCHANDISE
Product availability is indicated in the online catalog at www.golfmegastore.it. The indicated delivery times are not binding, unless otherwise stated in a separate agreement. However, the Seller makes every effort to respect these times. The Seller cannot guarantee that availability is accurate in every case. In such an event, the Buyer will be informed immediately that the goods will not be delivered, and any payments already made by the Buyer will be refunded without further delay. Upon receipt of the goods, the Buyer must immediately check that the delivery is complete and correct and inform the Seller of any problems without delay by emailing info@golfmegastore.it

4. PRICES AND SHIPPING COSTS
The price of the Products is the one resulting from the prices published on the website on the day the order is placed and before the Order is placed. The prices indicated refer to the price of the product including VAT. Depending on the country of delivery, shipping costs will be displayed upon ordering and before finalizing the order. Any other costs, charges, taxes, and/or indirect duties that a country may apply for any reason to the products being sold will be borne by the buyer. By accepting these conditions, the buyer declares that his or her ignorance of such costs, charges, taxes, and/or indirect duties will not constitute grounds for withdrawal and cannot be charged to the seller in any way. It is the buyer’s responsibility to pay any appropriate taxes, duties, and other charges in his or her country of residence. The buyer indemnifies the seller from payment of such taxes, duties, and charges.

6. SELLER’S LEGAL GUARANTEE AND PLACE FOR SUBMITTING COMPLAINTS
The Seller issues, pursuant to and for the purposes of Directive 44/99/EC, a legal warranty on the product in the event that it does not conform to the qualities specified in the sales contract. The warranty allows the Buyer, in case of product non-conformity defects, to obtain, by contacting the Seller directly, within reasonable time considering the nature of the goods, repair (if and to the extent possible), product replacement, price reduction or contract termination. In any case, the warranty does not cover use of the goods that is not in accordance with that established by the Seller/Manufacturer. Any complaint must be submitted providing proof of purchase (tax document issued by the seller/payment). The complaint must be submitted by the Buyer promptly and by email within 15 days from the date on which they ascertained the non-conformity defect. The Buyer and Seller agree and expressly accept that the date on which the Buyer can ascertain the non-conformity defect coincides with the product delivery date. Therefore, by accepting these commercial conditions, the Buyer declares that any complaint submitted after 15 days from the delivery date cannot be enforced against the Seller, who in any case reserves the right, at their sole discretion, whether to accept it or not. During this period the product cannot be used. The complaint is submitted via email to the Seller, who will immediately inform the Buyer of the service point and the methods through which to deliver the product. The after-sales service will be managed directly by Golf 2.0 Megastore.

7. PRODUCT LIABILITY AND COPYRIGHT
The provisions of Directive 85/374/EEC apply regarding damage caused by the product. The Seller, as distributor, releases itself from all liability, without exclusion and/or exception, by indicating the name of the manufacturer. All content on the website www.golfmegastore.it is protected by copyright. All rights belong to Swing Golf SRL and its manufacturing and supplier partners depending on the content. This website may not be reproduced in whole or in part, transferred by electronic or conventional means, modified, linked, or used for public or commercial purposes without the prior written consent of Swing Golf SRL.

8. APPLICABLE LAW AND PLACE OF JURISDICTION
The applicable law is Italian law, but the Buyer cannot be denied any rights that are inalienable under the laws of its country. Any dispute arising from or in any way connected to these “General Conditions of Sale” shall be submitted to the jurisdiction of the Court as defined by the provisions of the Consumer Code (Legislative Decree no. 206 of 6 September 2005). If the Parties have professional relationships, the Parties, by accepting these Conditions of Sale, agree and accept the exclusive jurisdiction of the Court of Vicenza.

9. FINAL PROVISIONS AND FORCE MAJEURE
If any of these general terms and conditions proves to be invalid or becomes invalid at a later date, this does not affect the validity of the remainder of this contract. In such case, the invalid term is replaced with a term that represents as closely as possible its intent and economic purpose or with the appropriate legal provisions. Therefore, the Parties agree and accept that the invalidity of a term and/or condition is not a substantial legal element for the purpose of voidability or nullity of the agreement since they declare that good faith in the execution of the contract is preserved and that the Parties could not have known of said invalidity at the time of conclusion of the agreement. The Seller reserves the right to amend these general terms and conditions at any time. The Seller is exempted from all liability for the total or partial non-fulfillment of any obligation set forth in these General Conditions of Sale if such non-fulfillment is caused by unforeseeable events and/or natural events beyond the control and responsibility of the Seller including, by way of example but not exhaustively, natural events (disasters), acts of terrorism, wars, popular riots, connectivity malfunction, lack of electrical power, general strike of public and/or private workers, strike and/or restrictions regarding courier and air connection traffic.
